I. GDPR Product Usage Privacy Notice Scope of the GDPR Notice
This GDPR Product Usage Privacy Notice (“GDPR Notice“) is provided by PDF Solutions, Inc., 2858 De La Cruz Blvd, Santa Clara, CA 95050 (USA) (“we“, “us“, “our“) to each data subject (“you“, “your“) who is a resident of the European Economic Area and whose personal data is subject to processing as an authorized user of PDF product(s) and/or service(s) (each a “PDF Product”). Your access to the PDF Product(s) is provided to you by our enterprise customer and your affiliated organization as an employee, contractor or other authorized user of the organization, and we have no direct relationship with you.
II. Data Transfers out of the EEA
As a non-EU entity, we may need to transfer your personal data outside of the European Economic Area for processing in order to facilitate your use of the PDF Product(s). This transfer of personal data outside of the EEA is effected by entry into a data transfer agreement (the “DTA”) based on Standard Contractual Clauses between your organization as the controller and data exporter and us, PDF Solutions, Inc., as the processor and data importer, providing assurances that appropriate safeguards have been provided to ensure that the personal data transferred out of the EEA shall continue to receive an adequate level of data protection and the data subjects in the EEA shall be able to enforce their rights and seek effective legal remedies as data subjects under GDPR. III. Right of Redress as Third Party Beneficiaries
As a data subject, you have the right to invoke and enforce certain clauses of the DTA if you are a third party beneficiary, if applicable. Please contact us at [email protected] if you wish to obtain further information with respect to the provisions of the DTA or to file a complaint.
IV. Use of Your Personal Data
The use of your personal data will be limited to the purpose of providing the products and/or services to our customers. If your personal data has been collected and processed as an authorized user of our products and/or services, and you would like to correct, amend, or delete inaccurate data, please direct your inquiry to our customer (the data controller).
PDF will retain personal data we process on behalf of our customers for as long as needed to provide services to our customers, and/or to comply with our legal obligations, resolve disputes, and enforce our agreements.
